An extremely notable international trade development has just occurred when the Office of the United States Trade Representative USTR officially included Vietnam in the group of "Priority Foreign Countries" Priority Foreign Country in Special Report 301 in 2026
This is the highest warning level in the US intellectual property monitoring mechanism.

Immediately after this move, the Vietnam Association of Seafood Exporters and Producers (VASEP), representing about 320 member businesses, immediately issued warnings and urgent recommendations to the business community exporting to the US.

According to USTR, Vietnam is currently assessed as not fully meeting the requirements for:

* intellectual property protection
* control counterfeit goods
* supply chain transparency
* traceability
* enforce software and digital data copyrights

It is worth noting that Vietnam is the ONLY country included in the Priority Foreign Country group in the review of more than 100 trading partners in 2026.

Under the Special 301 mechanism, within 30 days USTR may consider:

* open investigation under Section 301
* apply trade measures
* tighten import standards
* increase tariff pressure on Vietnamese goods

VASEP warns businesses that they need to urgently:

* Check the software used
* standardize intellectual property records
* registered trademark
* Check data and packaging legality
* increase traceability

INDUSTRIES MAY BE UNDER PRESSURE

Industry Level of influence
Seafood Very high
High wood and furniture
High Electronics
Textile Medium
Software outsourcing Cao
High e-commerce

The US is still Vietnam's largest export market:

* Turnover in the first 4 months of 2026 is about 53.9 billion USD
* Trade surplus is nearly 46.9 billion USD
* many industries are strongly dependent on the US market

What worries businesses the most is not an immediate round of taxes but the trend the US is having:

* Tighten supply chain control
* use intellectual property as a trade barrier
* increasingly demanding data transparency
* increased trade investigations under Section 301

WHAT BUSINESSES NEED TO DO

Action Target
Trademark registration Reduces the risk of disputes
Standardize data Increase transparency
Review section mAvoid IP violations
Increase traceability Meets American standards
Store digital records Proactively investigate

In a rapidly changing global trade context, this is considered a signal that:

* The US is tightening import standards
* Vietnamese businesses are forced to raise management standards
* intellectual property becomes the new "passport" for exports

If handled well, Vietnam still has a chance:

* improve business quality
* increase international competitiveness
* Deeper participation in the global supply chain

But if you are slow to adapt, there is a risk of:

* commercial investigation
* tighten exports
* increased technical barriers
* lost international orders

is completely possible
